1. Acceptance of terms

By accessing or using POPilot at getpopilot.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

2. Description of service

POPilot is a purchase-order decision tool for Amazon FBA sellers. The Service connects to your Amazon Seller Central and Amazon Advertising accounts via Amazon's official APIs to provide inventory analysis, PO recommendations, AWD/FBA placement optimization, and related features. POPilot is an independent software application and is not affiliated with, endorsed by, or sponsored by Amazon.

3. Account registration

You must create an account to use POPilot. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when registering and to update your information to keep it accurate. You must be at least 18 years old to use the Service.

4. Amazon account connection

To use the core features of POPilot, you must authorize the Service to access your Amazon Seller Central and/or Amazon Advertising accounts. By connecting your Amazon accounts, you grant POPilot permission to access and use your Amazon data solely for the purpose of providing the Service. You may revoke this access at any time through your Settings page or directly through Amazon Seller Central. POPilot will only request the minimum permissions necessary to provide the Service and will not use your Amazon data for any purpose other than powering POPilot features.

5. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to violate any applicable laws or regulations, to attempt to gain unauthorized access to any part of the Service, to interfere with or disrupt the Service or its servers, to reverse engineer or attempt to extract the source code of the Service, or to use the Service to compete with POPilot by building a similar product.

6. Recommendations and accuracy

POPilot provides purchase-order recommendations based on data from your Amazon accounts and information you provide. These recommendations are for informational purposes only and do not constitute financial or business advice. POPilot makes no guarantee that its recommendations will result in profitable outcomes. You are solely responsible for all purchasing decisions you make. The accuracy of recommendations depends on the accuracy and completeness of the data available, including data from Amazon's APIs which may be subject to delays or limitations.

7. Subscription and payment

POPilot offers paid subscription plans. By subscribing, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing at any time with reasonable notice. If you cancel your subscription, you will retain access to the Service until the end of your current billing period.

8. Intellectual property

The Service and its original content, features, and functionality are owned by POPilot and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission. Your data remains your property. By using the Service, you grant POPilot a limited license to use your data solely for the purpose of providing and improving the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us at support@getpopilot.com. Upon termination, your right to use the Service will immediately cease and we will delete your data within 30 days unless required by law to retain it.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. POPilot does not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, completeness, or usefulness of any recommendations or data provided by the Service.

11. Limitation of liability

To the fullest extent permitted by law, POPilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, loss of data, or business interruption. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
